1. Agreement to Terms

By accessing or using Sequenzy("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Sequenzy provides an email marketing platform that allows users to create, send, and manage email campaigns, automate email sequences, manage subscriber lists, and analyze campaign performance.

3. Account Registration & Vetting

  • You must provide accurate, complete, and current information during registration
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access or security breach
  • You may not use another person's account without permission
  • You must be at least 16 years old to create an account
  • All new accounts require a valid payment method before sending emails. This helps us prevent abuse and maintain high deliverability for all customers.
  • We manually review every new account before enabling full sending capabilities. This vetting process ensures compliance with our anti-spam policies.

4. Acceptable Use & Anti-Spam Policy

Sequenzy maintains a strict zero-tolerance policy for spam and email abuse. Violation of this policy will result in immediate account suspension without refund.

4.1 Prohibition of Purchased, Rented, or Scraped Lists

Users are strictly prohibited from using purchased, rented, borrowed, or scraped email lists. All recipients must have provided explicit, verifiable consent to receive emails from you. This includes:

  • Lists purchased from any third-party provider
  • Lists rented or borrowed from partners or affiliates
  • Email addresses harvested or scraped from websites
  • Lists obtained through contests or giveaways where email marketing consent was not explicitly granted
  • Append services or email lookup tools used to find addresses

4.2 Bounce Rate & Complaint Rate Limits

Sequenzy reserves the right to immediately suspend any account that exceeds the following thresholds:

  • Bounce rate exceeding 5% - Indicates poor list quality or outdated contacts
  • Spam complaint rate exceeding 0.1% - Indicates recipients did not consent to receive your emails

We actively monitor these metrics per account using automated systems. Accounts exceeding these limits will be automatically paused pending review.

4.3 Prohibited Content

The following types of content are strictly prohibited on our platform:

  • Gambling, casinos, or betting services
  • Multi-level marketing (MLM) or pyramid schemes
  • Payday loans or high-interest lending services
  • Adult content, pornography, or sexually explicit material
  • Cryptocurrency or forex trading schemes
  • Affiliate marketing without clear disclosure
  • Phishing, fraud, or deceptive practices
  • Illegal products or services
  • Content promoting violence, hate speech, or discrimination

4.4 Enforcement & Account Suspension

We enforce these policies through the following mechanisms:

  • Automated monitoring: Real-time tracking of bounce rates, complaint rates, and content patterns
  • Automated pausing: Accounts exceeding thresholds are automatically suspended within minutes
  • Manual review: Our compliance team reviews flagged accounts and first campaigns from new users
  • Global suppression list: Hard-bounced addresses are added to a platform-wide suppression list
  • No appeals for spam: Accounts terminated for sending spam are not eligible for reinstatement

5. Email Compliance

You are responsible for ensuring your email campaigns comply with all applicable laws, including:

  • CAN-SPAM Act (US)
  • GDPR (European Union)
  • CASL (Canada)
  • Other applicable anti-spam and privacy laws

All emails must include a valid physical address and a clear unsubscribe mechanism. Unsubscribe requests must be honored within 24 hours.

6. Subscriber Data

  • You retain ownership of your subscriber data
  • You warrant that you have obtained proper consent to email your subscribers
  • You are responsible for honoring unsubscribe requests promptly
  • We may remove subscribers who report your emails as spam
  • Subscribers who hard-bounce will be automatically added to our global suppression list and cannot be re-imported

7. Payment Terms

  • A valid payment method is required before you can send any emails
  • Paid plans are billed in advance on a monthly or annual basis
  • Fees are non-refundable, including for accounts suspended due to policy violations
  • We reserve the right to change prices with 30 days notice
  • Failure to pay may result in account suspension

8. Intellectual Property

  • The Service and its original content, features, and functionality are owned by Sequenzy
  • You retain ownership of content you create and upload
  • You grant us a license to host and display your content as necessary to provide the Service

9. Service Availability

We strive to provide reliable service but do not guarantee 100% uptime. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

10. Limitation of Liability

To the maximum extent permitted by law, Sequenzy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Sequenzy and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms, including claims related to spam complaints or violations of anti-spam laws.

12. Termination

  • You may terminate your account at any time through account settings
  • We may suspend or terminate your account immediately and without notice for violation of these Terms, particularly the Anti-Spam Policy
  • Upon termination, your data will be deleted within 30 days
  • Accounts terminated for spam violations are not eligible for refunds

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Sequenzy operates, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting on our website or sending an email. Your continued use of the Service after changes constitutes acceptance of the new Terms.
